Mitchell Fuller

Mitchell is a passionate civil litigation lawyer – having appeared and secured successful results as a solicitor advocate in the Victorian Civil and Administrative Tribunal, the Magistrates' Court, and Fair Work Commission proceedings.

Biography

He practices across a broad range of civil litigation matters and is particularly interested in trade mark, copyright, and design infringement disputes, trust and succession disputes, Fair Work matters, and multi-jurisdictional litigation.

In addition to civil litigation, he is experienced in criminal law, civil penalty matters, and Proceeds of Crime litigation.

Mitchell is as equally confident and comfortable appearing in courts and tribunals as he is drafting pleadings. A confident public speaker, he enjoys appearance work.

An advocate for social justice, Mitchell is a volunteer for Melbourne Activist Legal Service and Refuge of Hope. He is keenly interested in electoral politics and won preselection as a candidate for Malvern in the Victorian state election of 2022.

More personally, Mitchell is bilingual – speaking Spanish at an intermediate level – and a dedicated social activist in relation to environmental issues.

Examples of work

  • Advised the owner of a well-known series of trade marks in the restaurant industry, registered their Trade Marks internationally and, with counsel, successfully litigated against a number of infringing businesses in Federal jurisdiction

  • Advised a Part IV claimant in estate litigation at mediation, and secured a strong result for the client

  • Successfully brought an unfair dismissal claim for an ex-employee against a major company in its field
